These terms govern the use of florencestore.com.au, trading as Florence Store under a registered Australian Business. If you do not agree with these terms you must not use this website. Florence Store reserves the right to update or modify these terms at any time without notice. Continued use of the website constitutes acceptance of any updated terms.
- You agree that in the instance there is a dispute of any nature between you and Florence Store, these terms and conditions shall be governed and construed in accordance with the laws of Australia. Nothing in these terms excludes or limits any rights you may have under Australian Consumer Law.
3 a. You understand and accept that Florence Store accepts no responsibility for any loss, damage, corruption, or injury caused to your hardware, software or data through use of this website.
3 b. While Florence Store aims to provide accurate and current information on this website, errors or historical information may appear. Florence Store reserves the right to modify the content of this website at any time without notice and has no obligation to update information once published.
- Florence Store owns the rights to all content appearing on this website including text, images, graphics, video, product descriptions and layout unless otherwise stated. No material from this website may be reproduced, copied or distributed without prior written consent.
5 a. If you purchase using this website you are bound by any terms or conditions notified during checkout or described on website pages, product listings, policy pages or confirmation emails.
5 b. By clicking the “Place Order” button you confirm that you have read and agreed to the terms, policies and conditions presented during the checkout process.
- In the absence of any direct communication, all terms applicable to your purchase are contained within these Terms and Conditions or the policy pages available on the website including returns, help and shipping documentation.
7 a. By placing an order you are making an offer to purchase goods from Florence Store. Florence Store reserves the right to accept or decline any order placed through the website.
7 b. An order is considered accepted once a dispatch confirmation email has been issued. Florence Store reserves the right to cancel any order at its discretion. If an order is cancelled by Florence Store, the original payment method will be refunded.
7 c. If part or all of an order cannot be fulfilled, the unavailable item will be refunded to the original payment method and the remainder of the order may be dispatched as usual.
8 a. While Florence Store aims to display products accurately, discrepancies may occur in colour, measurement, description or imagery due to lighting, screen displays, manufacturing processes or product updates.
8 b. Florence Store reserves the right to change product descriptions, measurements or images without notice.
- No variation of these terms will be binding unless agreed in writing by Florence Store. Florence Store reserves the right to supply goods of equivalent style, colour or type where minor variations occur in production.
10 a. Florence Store operates a store credit return policy in accordance with Australian Consumer Law. Customers may return full priced merchandise, including items temporarily discounted, by booking a return within ten days of receiving their purchase. Approved returns will receive a store credit issued to the email address associated with the order.
10 b. Merchandise must not be worn, washed or damaged and must be returned in original condition with all tags attached. Items should be returned in their original packaging where possible. Returns that are worn, damaged or soiled may be rejected and returned to the sender.
10 c. Florence Store cannot accommodate order cancellation requests once an order has been placed as orders are immediately transmitted to our warehouse for processing and dispatch.
10 d. Where Florence Store determines that a refund is appropriate, refunds will only be issued to the original payment method used at checkout.
10 e. Florence Store reserves the right to modify or update its returns process at any time.
10 f. Florence Store is not able to redirect, transfer or resend an issued store credit to another email address or account once issued.
- Return postage and associated costs are the responsibility of the customer. Florence Store is not liable for items lost or damaged during return transit. Customers are responsible for ensuring safe return delivery.
- Florence Store does not offer exchanges. Customers wishing to obtain another size or item must place a new order.
- Non-returnable goods will be clearly identified on the product page. These items cannot be returned unless deemed faulty under Australian Consumer Law.
14 a. Ownership of goods and associated risk passes to the customer once the dispatch confirmation email has been issued.
14 b. Florence Store is not responsible for parcels that are lost, stolen, damaged or delayed after they have been transferred to the delivery carrier, including Australia Post.
- This agreement exists solely between the customer and Florence Store. Third party services including payment providers and delivery carriers operate under their own independent terms and policies.
- Purchases made using Afterpay are subject to Afterpay’s own terms and conditions. Florence Store is not responsible for the policies, communications or decisions made by Afterpay.
- Purchases made using PayPal are governed by PayPal’s own terms and dispute processes. Florence Store is not responsible for PayPal’s decisions or procedures.
- Payments processed through credit card gateways including Stripe are subject to the terms and conditions of the payment provider.
- Communication between Florence Store and customers is governed by our Privacy Policy. Customers will only receive communication required to process orders, requested by the customer or permitted by law.
20 a. By entering your email address into any field on the Florence Store website you consent to receiving email communication. You may unsubscribe at any time using the link in the email footer.
20 b. By entering your mobile phone number you consent to receiving SMS communication from Florence Store. Consent is not a condition of purchase and you may opt out at any time.
21 a. Discounts and promotional offers may be communicated through the website or marketing channels. Florence Store reserves the right to change or withdraw promotions at any time without notice.
21 b. Coupons cannot be applied to previous orders and Florence Store is not obliged to refund or reimburse any discount amount on prior purchases.
21 c. Influencer coupons are valid on full priced products only and are limited to one use per customer unless otherwise stated.
- Store credits are issued via email and must be redeemed during checkout using the associated email address.
22 a. Store credits cannot be transferred to another email address.
22 b. If a store credit cannot be located customers may contact Florence Store for assistance locating it.
22 c. Store credits issued for returns are subject to any applicable promotional exclusions.
- Welcome coupons are valid on a customer’s first purchase only. They cannot be used in conjunction with other discounts, applied to previous orders or reused following a return that generated store credit.
24 a. Promotions or competitions run by Florence Store are not sponsored, endorsed or administered by Instagram, Facebook or other social media platforms.
24 b. Prize conditions and entry requirements will be communicated on the relevant competition post or page.
24 c. Prizes are not transferable and cannot be exchanged for cash.
25 a. Shipping costs are the responsibility of the customer unless otherwise stated.
25 b. Orders are dispatched from our Brisbane warehouse within the timeframe stated on the product page or shipping policy.
25 c. Once a parcel has been dispatched from our warehouse, responsibility for transit, delivery and tracking updates rests with the delivery carrier including Australia Post.
25 d. Florence Store is not responsible for delays caused by delivery carriers, weather events, network congestion, customs processes, public holidays or other circumstances outside our control.
25 e. If a parcel is delayed or missing in transit, customers must lodge an enquiry directly with the delivery carrier using the tracking information provided.
- Prices for products may change at any time without notice. Florence Store is not liable for price changes occurring after an order has been placed.
- Sale prices apply only during the promotional period shown. Florence Store is not obliged to honour previous sale prices or reimburse price differences after purchase. Sale items may be marked final sale and may not be eligible for return unless deemed faulty.
- Where a store voucher has been issued or purchased at a discounted value, further promotional discounts may not apply to purchases made using that voucher.
- Items listed as pre-order are not currently in stock and will ship within the timeframe stated on the product page. Dispatch timeframes are estimates and may change due to manufacturing or freight delays outside Florence Store’s control. By placing a pre-order you accept the stated dispatch timeframe. Pre-orders cannot be cancelled once placed.
- Garment measurements, model heights and fit descriptions are provided as a guide only. Fit may vary depending on body shape, proportions and personal preference. Customers are responsible for reviewing measurements prior to purchase.
- Florence Store reserves the right to refuse service, cancel orders or restrict access to the website where customers engage in abusive behaviour, fraudulent activity, repeated chargebacks or misuse of store policies.
- Florence Store reserves the right to verify orders or payment details where suspicious or fraudulent activity is suspected. Orders may be cancelled if verification cannot be completed.
- Florence Store does not guarantee uninterrupted or error free access to the website and accepts no liability for temporary service interruptions.
